North Shore Poke Co. — Huntington Beach

Privacy Policy & Terms and Conditions

Prepared November 2, 2026 • Draft for owner and legal review

This package contains two separate website policies. Rewards and loyalty programs are excluded. Review the private checklist at the end before publishing. The policies must match the restaurant’s actual practices; they are not a guarantee of legal compliance. A California attorney should review the completed policies. Bracketed fields require completion.

PRIVACY POLICY

Effective date: [Insert date published]

1. Who we are

North Shore Poke Co. (“we,” “us,” or “our”) operates the Huntington Beach restaurant at 214 5th St., Suite 101, Huntington Beach, CA 92648. This policy explains how we collect, use, and disclose personal information in connection with our website, restaurant orders, catering, electronic gift cards, and customer communications for this location.

Website: https://www.northshorepokeco.com/
Phone: 714-465-9011
Email: shawn.gole@gmail.com

This policy does not cover independently operated locations or the separate information practices of third-party services.

2. Information we collect

Depending on how you interact with us, we collect information you provide when placing an order, requesting catering, purchasing an electronic gift card, contacting us, or subscribing to communications. This may include:

  • Your name, email address, phone number, and any address needed for fulfillment.

  • Order details, purchase history, payment status, and transaction or refund records.

  • Gift-card purchaser and recipient details needed to deliver or administer the gift.

  • Catering requests, event details, and information you include in communications.

  • Email and SMS preferences, including records of consent and opt-out requests.

Please provide only information needed for your request. If you provide another person’s information for gift delivery or fulfillment, use it only with appropriate authority. Receiving a gift does not automatically enroll the recipient in marketing.

Payments are processed through the service used for your transaction, including Clover where applicable. Payment providers collect information needed to authorize and process payments. We receive transaction information necessary to fulfill orders and maintain business records. Please do not send payment-card details by ordinary email or text.

We also receive relevant order information from services such as Uber Eats when you place an order through them.

3. Website technology and tracking

[Complete before publication: Identify the website host and any active forms, analytics, cookies, advertising pixels, or embedded services. Describe the technical information collected, purposes, provider categories, and available controls. State whether third parties collect personal information over time and across other websites, and describe the site’s actual response to Do Not Track signals. Separately confirm and describe Global Privacy Control handling where applicable.]

You can manage cookies through your browser settings. Restricting cookies may affect website functions and does not necessarily prevent all tracking.

4. How we use information

We use relevant information to:

  • Process and fulfill orders, catering requests, and electronic gift-card transactions.

  • Communicate about purchases, service changes, and customer questions.

  • Investigate order problems and administer appropriate corrections or refunds.

  • Send subscribed-to email or text communications about specials, menu news, events, and restaurant updates.

  • Maintain business records, prevent misuse, and meet legal obligations.

[If analytics or advertising tools are active, add their specific purposes after checking the settings.]

5. When we disclose information

We disclose information as reasonably necessary to providers supporting payment processing, ordering, fulfillment, website hosting, customer service, and communications. Clover supports our online ordering, point-of-sale, and payment services. Uber Eats handles orders placed through its platform and supplies information needed for fulfillment.

[Confirm before publication: Add GoHighLevel if active, identify its actual role, and identify any additional ordering, gift-card, analytics, or advertising providers in use.]

Providers processing information on our behalf may use it to perform their services subject to applicable restrictions. Services you use directly may also process information under their own privacy policies. This policy governs our own handling of information we receive.

We may disclose information when required by law or reasonably necessary to investigate fraud, protect safety, or establish or defend legal rights.

[Complete before publication: Verify and disclose whether any practices constitute selling personal information or sharing it for cross-context behavioral advertising under California law. Do not insert a blanket “we never sell or share” statement without checking tracking and provider settings.]

6. Email and SMS privacy

You may unsubscribe from promotional emails using the unsubscribe instructions in those messages. We may still send necessary non-promotional communications about a transaction or inquiry.

Promotional text messages require a separate opt-in. Making a purchase, following our social media pages, or subscribing to email does not by itself enroll you in promotional texts.

We do not sell, rent, or disclose mobile information to third parties or affiliates for their own marketing or promotional purposes. Text-message opt-in records and consent are not shared for unrelated marketing. Providers helping us operate or support the messaging program may process necessary information solely for those services, subject to applicable restrictions. Legally required disclosures remain subject to applicable law.

Reply STOP to unsubscribe from the text program or HELP for assistance. You may also contact shawn.gole@gmail.com or 714-465-9011. See our Terms and Conditions for messaging details. [Link to the published Terms and Conditions page.]

7. Retention and security

We retain personal information for as long as reasonably necessary for the purposes described here, including fulfilling transactions, maintaining legally required records, resolving disputes, and documenting consent. We may retain opt-out records to prevent unwanted future marketing.

We use reasonable safeguards appropriate to the information we handle. No transmission or storage system can be guaranteed completely secure.

8. Your questions and requests

To ask about your information or request access, correction, or deletion, contact shawn.gole@gmail.com, call 714-465-9011, or write to the restaurant address above. We may request information reasonably needed to verify your identity and will respond as required by applicable law. Some records may need to be retained for legal, transaction, or other permitted purposes.

[Before publication: Determine whether the California Consumer Privacy Act applies. If it does, add a complete California notice based on actual practices, including applicable rights, request procedures, required category and retention disclosures, and opt-out mechanisms. This paragraph is not a substitute for that notice.]

9. Children’s online privacy

Our restaurant welcomes families and younger guests. This is separate from collecting personal information online.

[Owner confirmation required for the following proposed practice:] Our website and email/SMS marketing programs are intended for a general audience and are not directed to children under 13. We do not knowingly collect personal information online from children under 13. Parents or guardians should handle online communications and subscriptions on behalf of younger children using their own contact information. If you believe we have collected personal information online from a child under 13, contact us so we can review and address it appropriately.

10. Updates

We will post changes to this policy on this page and revise the effective date. We will provide additional notice or obtain consent when required by law. Changes do not override rights or consent requirements applicable to information already collected.

TERMS AND CONDITIONS

Effective date: [Insert date published]

1. About these terms

These terms cover the website and applicable direct services of North Shore Poke Co., Huntington Beach, located at 214 5th St., Suite 101, Huntington Beach, CA 92648. They do not govern independently operated locations.

Contact us at 714-465-9011 or shawn.gole@gmail.com.

Please review the terms applicable to your order or subscription before submitting it. Where agreement is required, the relevant terms will be presented at checkout or enrollment. Our Privacy Policy describes our information practices. [Link to the published Privacy Policy page.]

2. Menu, availability, and prices

Menu items, ingredients, hours, and availability may change. Contact the restaurant for current information or ingredient questions. Prices and fees may differ between restaurant purchases and third-party ordering services. Applicable charges will be disclosed before payment.

Orders are subject to acceptance and availability. If an error or unavailable item affects your order, we will work with you on an appropriate correction, substitution with your agreement, or refund. Preparation and delivery times are estimates.

3. Ordering and payment

Review your items, contact information, and pickup or delivery details before submitting an order. Clover is used for online ordering, payment, and point-of-sale transactions. Uber Eats orders are also subject to the platform terms presented when ordering.

For questions about a direct order, call the restaurant. For a platform order, the platform’s support process may be needed to adjust payment, delivery, or refunds. This does not limit our own responsibilities or your rights under applicable law.

4. Cancellations, uncollected orders, and refunds

We understand that circumstances vary. Cancellation requests, uncollected orders, incorrect or missing items, and other order concerns are reviewed case by case.

Please contact us promptly at 714-465-9011 with your order details. Management will review the circumstances, including preparation status and the nature of the issue, and determine an appropriate resolution, which may include a correction, replacement, credit, or refund. We will honor any refund or other remedy required by law.

Changes or cancellations may not be possible after preparation begins. Please tell us promptly if you cannot collect your food; perishable food cannot be held indefinitely. These terms do not impose an automatic forfeiture or blanket “no refunds” rule.

For Uber Eats orders, use the help function associated with your order and contact us about restaurant-related issues. Applicable platform procedures may govern how a refund is processed.

5. Catering

Catering orders should be placed at least 48 hours in advance, as stated on our catering menu, and remain subject to availability and restaurant confirmation.

Confirm quantities, menu selections, timing, and pickup or delivery arrangements directly with us. Any deposit, payment deadline, cancellation charge, or rescheduling condition will be disclosed and agreed upon before payment. We do not impose an undisclosed nonrefundable deposit through these terms. Catering concerns will be reviewed based on the circumstances and any agreed written terms, subject to applicable law.

6. Electronic gift cards

Electronic gift cards are available. Please check the recipient’s information before purchasing and retain your purchase confirmation. Redemption methods and eligible ordering channels will be disclosed at purchase; do not assume a restaurant gift card can be used through Uber Eats or another third-party platform.

Purchased restaurant gift cards will be administered in accordance with applicable California law, including applicable restrictions on expiration dates and fees and required cash redemption. Where California’s cash-redemption rule applies, a gift card with a cash value of less than $15 is redeemable in cash upon request.

For delivery problems, balance questions, or a lost gift-card message, contact us with proof of purchase so we can investigate available assistance. These terms do not limit statutory gift-card rights.

7. Raw-food advisory and allergies

CONSUMER ADVISORY: Consuming raw or undercooked meats, poultry, seafood, shellfish or eggs may increase risk of foodborne illness, especially if you have certain medical conditions.

Our menu includes raw seafood. Please tell staff about food allergies before ordering and ask about current ingredients and preparation. Menu ingredient indicators are not a complete list of every possible allergen. Shared preparation areas and equipment can create a risk of allergen cross-contact, and we cannot guarantee that a meal is allergen-free.

Do not rely solely on an online order note to arrange an allergy accommodation; contact the restaurant to confirm whether your request can be accommodated. These notices do not waive customer rights or our food-safety obligations.

8. Email and SMS communications

Our communications may include restaurant specials, menu news, events, and operational updates, including weather-related changes affecting the restaurant.

North Shore Poke Co. Huntington Beach SMS Program

By separately opting in, you agree to receive recurring promotional text messages from North Shore Poke Co. Huntington Beach at the number you provide. Messages may be sent using automated technology. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply.

Reply STOP at any time to unsubscribe. You may receive a confirmation of your opt-out, after which messages under the canceled subscription will stop. To rejoin, complete a new opt-in. Reply HELP for assistance, email shawn.gole@gmail.com, or call 714-465-9011. Please notify us if your subscribed phone number changes.

Order-related texts, when separately requested, concern your transaction; requesting them does not enroll you in promotional messaging. Email subscribers may unsubscribe using the instructions in promotional emails.

Carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed. Restaurant weather updates are informational and are not an emergency-alert service. Use official sources for emergency instructions.

See our Privacy Policy for information about mobile data and consent records. [Link to the published Privacy Policy page.]

9. Website content and acceptable use

Website text, photographs, graphics, logos, and other content belong to the restaurant or their respective owners. Do not reproduce or commercially distribute protected content without permission, except as allowed by law.

Do not submit fraudulent orders, interfere with website operations, or attempt unauthorized access. Website access may occasionally be interrupted, and information may require correction.

10. Third-party services

Links to ordering, payment, delivery, and social media services lead to services operated by others. Their terms and privacy notices apply to their own services. We remain responsible for our own obligations to customers.

11. Applicable law and changes

California law governs these terms, subject to applicable federal law and mandatory consumer protections. Nothing here excludes liability or limits a right that cannot legally be excluded or limited.

We may update these terms prospectively by posting a revised effective date and providing additional notice where required. Updates do not retroactively change an accepted order or catering agreement without a lawful basis or your agreement.

PRIVATE OWNER / WEBSITE ADMINISTRATOR CHECKLIST

Do not publish this checklist as part of either policy.

The restaurant details, confirmed phone number, email, payment services, gift-card availability, catering lead time, raw-food advisory, and case-by-case refund approach have been incorporated. No rewards program has been included.

Before publication:

  1. Operator: Confirm North Shore Poke Co. is the complete legal operator name. Add the LLC/corporation or proprietor’s legal name if it is a trade name.

  2. Website data practices: Have the website administrator complete the bracketed tracking and provider sections. Confirm GoHighLevel’s active features. Clover is confirmed as the online ordering provider. A public webpage review cannot establish all back-end settings.

  3. California scope: Have counsel assess CCPA applicability. CalOPPA website privacy disclosures may still apply even where the CCPA does not. Review any advertising-related sale/sharing and Global Privacy Control obligations. Do not publish the unfinished California notice.

  4. Children: Confirm that children coming into the restaurant are not being enrolled directly in online marketing programs. The proposed general-audience wording must reflect actual design and collection practices; a policy sentence alone does not determine legal status.

  5. Operations: Verify that the stated security, retention, deletion-request, mobile-information restrictions, and unsubscribe practices are actually implemented. Recording/transcription or AI voice services need separate review if added.

  6. Gift cards: Confirm the issuer, delivery and redemption channels, and platform settings. Train staff on applicable cash-redemption requirements; keep purchased gift cards distinct from promotional discounts.

  7. SMS: Use a separate, optional, unchecked marketing consent box. Keep order-message consent separate. Preserve proof of consent and test STOP and HELP. Do not send promotional texts to email subscribers or social followers who have not opted in. Have the messaging provider review the final policy language and actual enrollment flow; policy text alone does not guarantee A2P approval.

  8. Links and dates: Publish two separate pages, set the effective dates, replace bracketed links with working URLs, and link both policies from the footer and relevant forms. Remove all review instructions.

  9. Menu and contact consistency: The supplied trifold has the transposed phone number 714-456-9011; update it to 714-465-9011. Check the catering webpage’s hours and update its online-ordering reference to Clover.

  10. Final review: Confirm allergy/cross-contact wording with the kitchen and have California counsel review both policies before publication. The supplied raw-food sign has not been independently verified as regulator-approved.
